#Introduction
Welcome to SKWADE.
These Terms of Service (“Terms”) govern your access to and use of the SKWADE platform, including its mobile applications, web services, websites, software, digital content and all related services (collectively, the “Services”).
Please read these Terms carefully before using SKWADE.
By creating an account, accessing or using any part of the Services, you acknowledge that you have read, understood and agree to be bound by these Terms, our Privacy Policy and any additional policies that apply to specific features or services.
If you do not agree with these Terms, you must not use SKWADE.
#SKWADE Principles
Before using SKWADE, we believe it is important to explain the principles that guide the design and operation of our platform. These principles are not legal obligations. They represent the values that influence how SKWADE is built and how we strive to serve the diving community.
Safety First. SKWADE is designed to assist divers, not to replace certified training, dive professionals, dive computers or sound judgment. Every dive remains the responsibility of the diver.
Privacy by Design. Privacy is considered from the earliest stages of product design. We strive to collect only the information necessary to provide our services while giving users meaningful control over their personal data.
Security by Design. Security is integrated into every layer of the platform. We continuously improve our technical and organizational safeguards to protect user accounts, personal information and diving records.
User Control by Default. Users decide what information they share, with whom they share it and when they share it. Private information remains private unless the user explicitly chooses otherwise.
Transparency Always. We believe users deserve clear explanations about how SKWADE works. Whenever possible, we explain our features, policies and data practices using straightforward language in addition to the legal requirements.
AI Assists, Humans Decide. Artificial Intelligence is designed to support users by providing information, education and productivity tools. AI never replaces certified instructors, medical professionals, official documentation or the user’s own judgment.
Your Memories Remain Yours. Your dives, photographs, observations, documents and personal achievements belong to you. SKWADE provides tools to organize and protect them but does not claim ownership over your personal content.
Respect the Ocean. SKWADE promotes responsible diving and environmental stewardship. We encourage every diver to:
- Explore with curiosity.
- Observe with respect.
- Protect what you discover.
Continuous Improvement. SKWADE is an evolving platform. We continuously improve our services based on user feedback, technological advances and the changing needs of the global diving community while maintaining our commitment to privacy, safety and transparency.
Our Mission. To build the most complete, trusted and responsible digital platform for divers worldwide. Every feature we develop should help divers dive more safely, learn continuously, preserve their memories, protect the underwater world, and stay in control of their information.
These principles provide the foundation for the Terms of Service that follow.
#Chapter 1 — Acceptance of these Terms
In Summary. By creating a SKWADE account or using any part of the Services, you agree to these Terms of Service. These Terms form a legally binding agreement between you and SKWADE. If you do not agree with these Terms, you must not access or use the Services.
#1.1 Agreement
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “your”, “User”) and SKWADE (“SKWADE”, “we”, “our”, “us”).
They govern your access to and use of all SKWADE Services, including:
- Mobile applications;
- Web applications;
- Websites;
- Cloud services;
- Digital Passport;
- Dive Log;
- Ocean Knowledge (including Marine Guide, Coral Guide, Dive Sites, and future Ocean domains such as Marine Plants, Habitats and Ocean Articles);
- Library;
- Help Center;
- Communication Center;
- Premium Services;
- Artificial Intelligence features;
- Future services provided by SKWADE.
#1.2 Acceptance
You accept these Terms by:
- creating a SKWADE account;
- signing in to SKWADE;
- accessing any SKWADE Service;
- using any feature of the platform.
Acceptance occurs whether the Services are used through iOS, Android, Web, or future supported platforms.
#1.3 Additional Policies
Certain SKWADE features are also governed by additional policies that form part of these Terms. These may include:
- Privacy Policy;
- Cookie Policy;
- Community Guidelines;
- Acceptable Use Policy;
- Copyright Policy;
- Security Policy;
- Premium Subscription Terms;
- other policies published within the Legal Center.
Where a feature has additional rules, those rules apply together with these Terms.
#1.4 Changes to the Services
SKWADE continuously evolves. We may introduce new features, improve existing functionality, discontinue features, modify Premium benefits, update supported platforms, and improve security or performance. Nothing in these Terms guarantees that a specific feature will remain available indefinitely.
#1.5 Availability
The availability of certain Services may depend on your country, your language, your subscription plan, your device, your operating system, technical compatibility, and legal requirements. Some Services may not be available in every jurisdiction.
#1.6 Compliance with Local Laws
Users are responsible for ensuring that their use of SKWADE complies with the laws and regulations applicable in their country or region. Nothing in these Terms authorizes the use of SKWADE where such use would be prohibited by applicable law.
#1.7 Future Features
SKWADE is an evolving platform. Future services may include features not currently available. Unless otherwise stated, these Terms automatically apply to future Services provided by SKWADE. Where additional conditions are required, they will be presented before the relevant feature is used.
#1.8 Language
These Terms may be translated into multiple languages for user convenience. In the event of any inconsistency between translations, the version designated by SKWADE as the controlling version shall prevail to the extent permitted by applicable law.
#1.9 Entire Agreement
Together with the documents incorporated by reference, these Terms constitute the entire agreement between you and SKWADE regarding the use of the Services. They replace any prior understandings relating to the same subject matter.
#1.10 Questions
If you do not understand any part of these Terms, we encourage you to consult the Help Center or contact SKWADE before using the Services. Using SKWADE indicates that you understand and accept these Terms.
#1.11 Core Principle
These Terms explain the rights and responsibilities of both users and SKWADE so that everyone can use the platform with confidence and clarity.
#Chapter 2 — Eligibility & Accounts
In Summary. To use SKWADE, you must meet the eligibility requirements described in these Terms and create an account using accurate information. You are responsible for maintaining the security of your account and for all activities that occur under it. If you no longer meet the eligibility requirements, or if your account is used in violation of these Terms, SKWADE may limit or suspend access as described later in these Terms.
#2.1 Eligibility
You may use SKWADE only if:
- you have the legal capacity to enter into a binding agreement under the laws applicable to you;
- your use of the Services is not prohibited by applicable law;
- you comply with these Terms and all applicable policies.
Certain Services may have additional eligibility requirements.
#2.2 Minimum Age
The minimum age required to create or independently use a SKWADE account depends on applicable local laws, platform requirements, and parental or guardian consent requirements where applicable. If you are below the age required by applicable law, you may only use SKWADE where a parent or legal guardian has provided any required authorization.
#2.3 Creating an Account
To access certain Services, you must create a SKWADE account. When creating an account, you agree to provide information that is accurate, current, complete and truthful. You are responsible for keeping your account information up to date.
#2.4 One Account Per User
Unless expressly authorized by SKWADE, each individual should maintain only one personal account. Creating multiple accounts to bypass feature limitations, avoid subscription restrictions, evade enforcement actions, misuse promotional offers, or manipulate platform functionality is prohibited.
#2.5 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to choose a strong password where applicable, protect your authentication methods, avoid sharing your account with others, sign out from shared devices, and notify SKWADE promptly if you suspect unauthorized access. You remain responsible for activities occurring through your account until you notify us of unauthorized use, where permitted by applicable law.
#2.6 Authentication Methods
SKWADE may support multiple authentication methods, including email and password, Sign in with Apple, Sign in with Google, and future supported identity providers. Authentication options may vary depending on the platform or region.
#2.7 Accurate Information
Certain SKWADE features rely on accurate user information. Examples include the Digital Passport, certifications, Dive Logs, synchronization, and Premium purchases. Providing false or misleading information may affect the availability or reliability of certain Services.
#2.8 Account Ownership
Your account is personal to you. Unless expressly authorized by SKWADE, accounts may not be sold, transferred, shared between multiple individuals, or used on behalf of another person in a misleading manner.
#2.9 Organizational Accounts
Future versions of SKWADE may support organizational accounts for dive centers, instructors, businesses, educational organizations, and conservation partners. Such accounts may be subject to additional agreements and permissions.
#2.10 Keeping Your Information Updated
You agree to keep important account information reasonably current, including email address, display name, contact information where applicable, subscription information, and authentication methods.
#2.11 Account Recovery
If you lose access to your account, SKWADE may offer account recovery procedures. Recovery may require verification of your identity to protect your information from unauthorized access. Recovery methods may evolve over time to improve security.
#2.12 Refusal of Account Creation
SKWADE reserves the right, where permitted by applicable law, to refuse the creation of an account where reasonably necessary to protect the platform, prevent fraud, comply with legal obligations, enforce these Terms, or maintain the security of users and Services. Where appropriate, SKWADE may provide information regarding such decisions.
#2.13 Responsibility for Your Account
You are responsible for all activity carried out through your account unless otherwise provided by applicable law. This includes uploaded content, Dive Logs, synchronization requests, Premium purchases, communications, use of AI features, and interactions with the Services.
#2.14 Core Principle
SKWADE provides secure authentication tools, while users remain responsible for maintaining the security of their own accounts.
#Chapter 3 — Definitions
In Summary. These Terms use certain words and expressions with specific meanings. Whenever these terms appear with an initial capital letter, they have the meanings described below unless the context clearly indicates otherwise.
#3.1 Account
Account means the personal user account created to access and use SKWADE Services. An Account may contain personal information, preferences, Dive Logs, Digital Passport information, subscriptions and other User Content.
#3.2 Artificial Intelligence (AI)
Artificial Intelligence or AI refers to automated technologies used by SKWADE to assist users by generating information, recommendations, search results, educational content or other intelligent features. AI assists users but does not replace professional advice, certified training or human judgment.
#3.3 Community Features
Community Features means any present or future functionality that allows users to interact with one another, share content or participate in community activities. Examples may include shared observations, comments, public profiles, clubs, conservation initiatives and social features.
#3.4 Content
Content means any information made available through SKWADE, including text, images, videos, documents, graphics, software, educational material, AI-generated responses, Help Center articles, and legal documents. Content may originate from SKWADE, users or third parties.
#3.5 Digital Passport
Digital Passport means the SKWADE feature that presents selected profile information, certifications, statistics and other diving-related information chosen by the user. It is intended as a convenience feature and is not an official identification document or certification.
#3.6 Dive Computer
Dive Computer means a compatible electronic diving device capable of recording dive information and, where supported, synchronizing data with SKWADE.
#3.7 Dive Log
Dive Log means the collection of diving records maintained by a user within SKWADE, including manually entered or imported dive information.
#3.8 Dive Planning Tools
Dive Planning Tools means the calculators and planning utilities available within SKWADE, including the Nitrox Calculator, NDL Calculator, Surface Interval Planner, Air Consumption Planner, Rock Bottom Calculator, CNS Calculator, OTU Calculator, Trimix Calculator, and other future planning tools. These tools are intended to assist users and do not replace certified training or safe diving practices.
#3.9 Library
Library means the SKWADE module used to store and organize photographs, videos, documents and other user-uploaded files.
#3.10 Ocean Knowledge
Ocean Knowledge means the SKWADE ecosystem of editorial and educational modules dedicated to the marine world. Ocean Knowledge currently includes the Marine Guide, the Coral Guide and Dive Sites, and may in the future include additional Ocean domains such as Marine Plants, Habitats and Ocean Articles.
Ocean Knowledge succeeds and expands the former “Marine Life” module. Where earlier documentation refers to Marine Life, those references shall be construed as referring to Ocean Knowledge to the extent permitted by context.
#3.11 Ocean Observations
Ocean Observations means the user-generated records of marine species, corals or other Ocean Knowledge entities encountered by a user. Observations may be created with or without a Dive Log, may include notes, dates and locations, and remain User Content.
#3.12 Premium
Premium means any paid subscription or enhanced service offered by SKWADE that provides additional functionality beyond the Free version. Premium features may change over time.
#3.13 Privacy Policy
Privacy Policy means the SKWADE Privacy Policy that explains how personal information is collected, used, stored, shared and protected. The Privacy Policy forms part of these Terms.
#3.14 Services
Services means all applications, software, websites, cloud services, APIs, digital content and related functionality made available by SKWADE.
#3.15 Third-party Services
Third-party Services means products or services provided by independent organizations that integrate with or support SKWADE. Examples include authentication providers, payment providers, mapping services, weather services, AI providers, cloud infrastructure, media providers and notification services.
#3.16 User
User means any individual or organization accessing or using SKWADE. Depending on the context, “you” and “your” refer to the User.
#3.17 User Content
User Content means information created, uploaded or submitted by users, including Dive Logs, photographs, documents, Ocean Observations, certifications, comments, notes, uploaded files, and other personal content. Unless otherwise stated, User Content remains the property of the user.
#3.18 Wallet Pass
Wallet Pass means a digital pass generated by SKWADE for use with supported digital wallet platforms, such as Apple Wallet or Google Wallet. A Wallet Pass is intended solely as a convenience feature.
#3.19 Website
Website means any official SKWADE website or web application operated by or on behalf of SKWADE.
#3.20 “Including”
Whenever the words “including”, “includes” or “such as” are used in these Terms, they mean “including, without limitation”, unless the context clearly indicates otherwise.
#3.21 Core Principle
Clear definitions create clear expectations. By defining important terms at the beginning of these Terms, SKWADE seeks to make the remainder of the document easier to understand and less open to misunderstanding.
#Chapter 4 — Acceptable Use
In Summary. SKWADE is designed to support divers, dive professionals and the global diving community. You agree to use the Services responsibly, lawfully and respectfully. You must not use SKWADE in ways that harm other users, interfere with the Services or violate applicable laws.
#4.1 Purpose
These Acceptable Use rules help protect users, dive centers, instructors, partners, the SKWADE platform and the diving community. By using SKWADE, you agree to comply with these rules at all times.
#4.2 Lawful Use
You may use SKWADE only for lawful purposes. You agree not to use the Services in any manner that violates applicable laws, regulations, court orders, sanctions, intellectual property rights, privacy rights, or contractual obligations.
#4.3 Respect for Other Users
You agree to treat all users respectfully. You must not harass, threaten, bully or discriminate against others, impersonate another person, or intentionally deceive other users. SKWADE seeks to foster a respectful and inclusive diving community.
#4.4 Accurate Information
You agree not to knowingly provide false or misleading information, including fake certifications, false identities, inaccurate Dive Logs intended to deceive, fraudulent Premium claims, or misleading professional qualifications. Honest mistakes may be corrected at any time. Intentional deception may result in enforcement action.
#4.5 Platform Security
You must not attempt to gain unauthorized access, bypass authentication, circumvent security measures, interfere with synchronization, exploit vulnerabilities, introduce malware, overload the platform, or perform denial-of-service attacks. Any attempt to compromise the security of SKWADE may result in immediate suspension and, where appropriate, legal action.
#4.6 Reverse Engineering
Except where expressly permitted by applicable law, you may not reverse engineer the Services, decompile software, extract source code, attempt to discover proprietary algorithms, or interfere with licensing mechanisms. This restriction does not limit rights that cannot legally be excluded.
#4.7 Automated Access
You may not use automated systems to scrape content, harvest user information, create accounts automatically, generate excessive requests, or interfere with normal platform operation. Reasonable automated access expressly authorized by SKWADE, such as future public APIs, is permitted in accordance with the applicable documentation and terms.
#4.8 User Content
You remain responsible for all content you upload. You must not upload content that is illegal, infringes copyright, violates another person’s privacy, contains malware, promotes violence or illegal activities, or contains fraudulent information. SKWADE reserves the right to remove content that violates these Terms.
#4.9 Diving Information
You must not knowingly use SKWADE to falsify diving experience, misrepresent certifications, create fraudulent Dive Logs, or manipulate diving statistics for deceptive purposes. Dive records should accurately reflect genuine diving activities.
#4.10 Artificial Intelligence
AI features must not be used to generate fraudulent documents, impersonate individuals, produce misleading certifications, facilitate illegal activity, or deliberately spread false safety information. AI features are intended to educate and assist — not to deceive.
#4.11 Third-Party Rights
You agree to respect the rights of other users, dive centers, instructors, certification agencies, equipment manufacturers, software providers, and copyright holders. You may not upload or distribute content that infringes intellectual property rights.
#4.12 Commercial Misuse
Unless expressly authorized by SKWADE, you may not use the Services to operate unauthorized commercial services, resell access, redistribute Premium features, create competing services using SKWADE content, or misuse SKWADE branding. Business and enterprise features may be governed by separate agreements.
#4.13 Responsible Diving
SKWADE promotes responsible diving. Users should dive within their training, respect local regulations, protect marine environments, avoid disturbing wildlife, follow dive briefings, and prioritize safety at all times. Nothing within SKWADE should encourage unsafe diving practices.
#4.14 Reporting Abuse
Users are encouraged to report abusive behavior, fraudulent accounts, security concerns, copyright violations, inappropriate content, and suspected misuse of the Services. Reports help maintain the integrity of the platform.
#4.15 Enforcement
If these Terms are violated, SKWADE may, where appropriate, issue warnings, remove content, restrict specific features, suspend accounts, terminate accounts, or report unlawful activity to competent authorities where legally required. Enforcement actions are intended to protect users, the platform and the diving community.
#4.16 Core Principle
SKWADE is built on trust, respect and responsible use. Every user contributes to the quality and safety of the platform through honest behavior, respectful interactions and responsible use of the Services.
#Chapter 5 — Dive Safety
In Summary. SKWADE is designed to support divers by providing educational resources, planning tools, dive logging and other digital services. However, SKWADE is not a substitute for certified dive training, professional instruction, dive computers, official procedures or sound personal judgment. Every dive is planned, conducted and completed solely under the responsibility of the diver and, where applicable, the dive leader or dive operator.
#5.1 Safety Is Your Responsibility
Diving is an activity that involves inherent risks. By using SKWADE, you acknowledge that you remain solely responsible for every decision made before, during and after a dive, including planning the dive, evaluating environmental conditions, selecting appropriate equipment, monitoring gas supply, respecting decompression limits, following local regulations, and determining whether it is safe to dive. SKWADE does not assume responsibility for these decisions.
#5.2 Educational Purpose
Many SKWADE features are designed to educate and assist divers, including the Help Center, Dive Planning Tools, Ocean Knowledge, AI Features, Dive Computer Synchronization, Weather Information, and Dive Log statistics. Unless expressly stated otherwise, these features are provided for informational and educational purposes only.
#5.3 Certified Training
SKWADE does not provide diving certification. Nothing within the Services replaces certified diving courses, practical instruction, supervised training, skill assessments, or continuing education. Users should always follow the standards established by their training agency and instructors.
#5.4 Dive Computers
Dive computers remain the primary source of dive information during a dive. SKWADE does not replace a dive computer, monitor dives in real time, calculate decompression during a dive, provide emergency dive management, or assume responsibility for dive computer decisions. If any difference exists between SKWADE and your dive computer, you should always rely on your dive computer and the safest available information.
#5.5 Dive Planning
Planning tools within SKWADE are intended to assist preparation. They must never replace certified planning methods, instructor guidance, manufacturer recommendations, local dive briefings, or conservative dive planning. Users remain responsible for validating every dive plan before entering the water.
#5.6 Weather and Marine Conditions
Weather forecasts, tides, currents and environmental information are provided solely to assist planning. Conditions at the dive site may differ significantly from forecasts. Users should always assess conditions on site, obtain local briefings, consider recent weather changes, and postpone dives whenever conditions appear unsafe.
#5.7 Medical Fitness
SKWADE does not determine whether a person is medically fit to dive. Only an appropriately qualified healthcare professional can assess medical fitness for diving. Medical Documents stored within SKWADE are provided solely for organization and accessibility.
#5.8 Artificial Intelligence
Artificial Intelligence features are intended to support users through explanations, educational content and intelligent assistance. AI does not replace physicians, marine biologists, certification agencies, or dive professionals. Users remain responsible for verifying AI-generated information before relying upon it.
#5.9 Ocean Knowledge
Ocean Knowledge modules — including the Marine Guide, the Coral Guide and Dive Sites — are educational resources. Species and coral suggestions should never be considered definitive scientific identification. Dive Site information is provided for educational and planning purposes and does not guarantee current local conditions.
Users should avoid disturbing marine life while attempting to obtain observations or photographs. Environmental protection should always take priority.
#5.10 Equipment
SKWADE does not inspect, maintain or certify diving equipment. Users remain responsible for ensuring that equipment is properly serviced, suitable for the planned dive, that manufacturer recommendations are followed, and that pre-dive safety checks are completed.
#5.11 Dive Centers and Professionals
Information displayed by SKWADE regarding dive centers, instructors, guides or other professionals is provided for informational purposes. Unless expressly stated, SKWADE does not certify, supervise or guarantee the services provided by independent operators. Users should evaluate providers independently before participating in diving activities.
#5.12 Emergency Situations
SKWADE is not an emergency service. The platform must not be relied upon to request emergency assistance, monitor divers, initiate rescue operations, provide emergency medical guidance, or replace emergency communication equipment. In any emergency, users should immediately contact the appropriate local emergency services.
#5.13 Assumption of Risk
By participating in diving activities, users acknowledge that scuba diving and related underwater activities involve inherent risks, including the risk of serious injury, permanent disability or death. Using SKWADE does not reduce or eliminate these risks. Users voluntarily assume these risks when participating in diving activities.
#5.14 Safety Recommendations
SKWADE encourages every diver to dive within the limits of their certification, maintain their skills through regular training, dive with an appropriate buddy whenever applicable, follow local regulations, respect marine environments, maintain equipment properly, and plan conservatively. These recommendations are not exhaustive and do not replace professional instruction.
#5.15 Core Safety Principle
SKWADE is a decision-support platform — not a life-support system. No feature should ever be relied upon as the sole basis for making a diving decision. Dive safely. Think conservatively. When in doubt, don’t dive.
#Chapter 6 — Dive Planning Tools
In Summary. SKWADE provides a range of dive planning tools intended to assist divers before and after a dive. These tools are educational and planning aids only. They are not dive computers, decompression software, life-support systems or substitutes for certified training and conservative dive planning. Users remain solely responsible for validating all calculations and making safe diving decisions.
#6.1 Purpose
Dive Planning Tools are designed to assist divers in understanding and preparing recreational and, where applicable, technical dives. Depending on your subscription and feature availability, these tools may include the Nitrox Calculator, No-Decompression Limit (NDL) Calculator, Surface Interval Planner, Air Consumption Planner, Rock Bottom Gas Calculator, CNS Exposure Calculator, OTU Calculator, Trimix Calculator, Gas Blending Tools, and future planning and educational calculators.
#6.2 Educational and Planning Use
All calculations provided by SKWADE are intended for educational purposes, dive preparation, understanding diving theory, estimating planning scenarios, and reviewing completed dives. They are not intended to control or monitor a dive in real time.
#6.3 User Responsibility
Before relying on any calculation, you are responsible for verifying all entered values, gas mixtures, cylinder specifications, planned depths, planned bottom times, ascent rates, environmental conditions, and applicable training standards. Incorrect input will produce incorrect results.
#6.4 No Absolute Reference
The results produced by SKWADE must never be considered the sole or absolute reference for planning or conducting a dive. Calculations are based on mathematical models, assumptions and the information provided by the user. Whenever differences exist between multiple planning sources, divers should adopt the safest and most conservative approach.
#6.5 Dive Computer Priority
During a dive, your dive computer remains the primary reference. If any discrepancy exists between SKWADE, your dive computer, your instructor, your training agency, or local dive procedures, you should always follow the most conservative guidance appropriate to your training and circumstances.
#6.6 Calculation Models
SKWADE may use recognized mathematical models and accepted diving formulas to perform calculations. Different organizations may use different models, and manufacturers may implement different algorithms. As a result, calculations may differ from other software or dive computers. Such differences do not necessarily indicate an error.
#6.7 Technical Diving
Some planning tools may be suitable only for divers who have received appropriate technical diving training. Access to advanced calculators does not imply that a user is qualified to perform technical dives. Users must remain within the limits of their certifications and experience.

No software can eliminate the risks associated with diving.

Calculation methods and planning tools may be updated over time to improve accuracy, correct defects, reflect current best practices, or introduce new educational features. Updates do not guarantee identical results across different versions of the application.
#6.10 Professional Advice
When planning complex dives, users should seek guidance from appropriately qualified professionals, including certified instructors, technical diving instructors, experienced dive leaders, and recognized training agencies. SKWADE should be considered one resource among many — not the only source of planning information.
#6.11 No Warranty of Accuracy
While SKWADE strives to implement calculations carefully and responsibly, no guarantee is made that every calculation will be error-free, complete, suitable for every diving situation, or appropriate for every user. Users acknowledge that dive planning involves personal judgment beyond mathematical calculations.
#6.12 Recreational and Technical Use
Certain planning tools are designed primarily for recreational diving, while others may support technical diving scenarios. Users are responsible for selecting tools appropriate to their certification level, training, the planned dive, and applicable standards.
#6.13 Future Planning Tools
As SKWADE evolves, additional planning tools may be introduced. Unless expressly stated otherwise, every future planning tool is subject to the principles described in this chapter.
#6.14 Core Principle
Conservative planning and informed human judgment remain essential to safe diving.
#Chapter 7 — Dive Log
In Summary. The Dive Log allows users to create, import, organize and preserve records of their diving activities. Your Dive Log is your personal diving journal. You remain responsible for the accuracy of the information it contains. SKWADE provides tools to manage your dive records but does not certify, verify or guarantee the accuracy of user-entered or imported information.
#7.1 Purpose
The Dive Log is designed to help divers maintain a complete and organized record of their diving activities. Depending on feature availability, the Dive Log may include manual dive entries, imported dive computer records, dive site information, dive buddy information, Ocean Observations, equipment used, environmental conditions, weather history, photographs and videos, personal notes, and statistics and achievements.
#7.2 Ownership of Dive Records
Except where required by applicable law, you retain ownership of the Dive Logs you create or import. SKWADE receives only the limited rights necessary to store your dives, synchronize your devices, display your dives within the application, create backups, and enable features you choose to use. Ownership of your diving history is not transferred to SKWADE.
#7.3 Creating Dive Logs
Users may create Dive Logs manually by entering information including date and time, dive site, country, maximum depth, dive duration, gas mixture, water temperature, visibility, equipment, dive buddies, and notes. Users remain responsible for ensuring that manually entered information is accurate.
#7.4 Imported Dive Logs
Where supported, Dive Logs may be imported from compatible dive computers. Imported information may include the dive profile, maximum depth, dive duration, water temperature, gas switches, surface intervals, GPS information where available, and manufacturer-specific data. Imported information remains subject to review and correction by the user.
#7.5 Editing Dive Logs
SKWADE allows users to edit Dive Logs after creation or import. Examples include correcting dive site names, adding photographs, updating equipment, correcting gas mixtures, adding notes, attaching certifications, and linking Ocean Observations. Where technically supported, SKWADE may distinguish between imported data and user-edited data to preserve the integrity of synchronized records.
#7.6 Accuracy
SKWADE does not independently verify manually entered dives, imported dives, certifications associated with dives, dive site selections, or environmental conditions. Users remain solely responsible for the accuracy of their Dive Logs.
#7.7 Statistics
The Dive Log may automatically generate statistics such as total dives, total dive time, maximum depth, average depth, number of countries visited, number of dive sites, equipment usage, Ocean Observations, and personal achievements. Statistics depend entirely on the information contained within the Dive Log and may therefore be incomplete or inaccurate if the underlying data is incorrect.
#7.8 Synchronization
Dive Logs may synchronize between supported devices using secure cloud services. Synchronization depends on network availability, account status, feature availability, and compatible software versions. Temporary synchronization delays may occur.
#7.9 Sharing Dive Logs
SKWADE may allow users to share selected Dive Logs or export them in various formats. Users remain responsible for deciding what information is shared, with whom it is shared, and when it is shared. Once exported, copies are no longer controlled by SKWADE.
#7.10 Dive Log Exports
Users may be able to export their Dive Logs in supported formats, which may evolve over time and may include PDF, CSV, universal dive log formats, and other compatible formats. Exporting data does not remove it from SKWADE.
#7.11 Imported Data Integrity
Manufacturer-generated dive data is imported as recorded by the compatible dive computer. SKWADE does not modify imported dive profiles except where the user explicitly edits editable information. Where technically supported, imported values and user modifications may be tracked separately to preserve the original imported record.
#7.12 Deleted Dive Logs
Users may permanently delete individual Dive Logs. Deleting a Dive Log may also remove associated statistics, Ocean Observations, photographs, videos, linked documents, and achievements. Deleted dives may remain temporarily in secure backups before permanent removal.
#7.13 Future Dive Log Features
Future versions of the Dive Log may include collaborative dive logs, instructor validation, digital signatures, conservation records, scientific observations, additional synchronization capabilities, and advanced analytics. Unless otherwise stated, such features remain subject to these Terms.
#7.14 Core Principle
Your memories remain yours. Your diving history remains your responsibility.
#Chapter 8 — Digital Passport
In Summary. The SKWADE Digital Passport provides a convenient digital presentation of selected diving information, including certifications, experience and personal profile details. It is intended to simplify interactions within the diving community but is not an official certification card, government-issued identification or legally recognized proof of qualification. Users remain responsible for ensuring that the information displayed is accurate and for providing official documentation whenever required.
#8.1 Purpose
The Digital Passport is designed to provide divers with a modern, secure and convenient way to present selected diving information. Depending on feature availability, the Digital Passport may display a profile photograph, display name, nationality, primary certification, certification history, diving statistics, Digital Passport ID, QR Code, membership status, and other information selected by the user.
#8.2 Information Displayed
The information presented within the Digital Passport is generated from your profile, certifications you have added, your Dive Log, subscription status, and other information managed within SKWADE. The Passport reflects the information currently available in your account.
#8.3 User Responsibility
You remain solely responsible for ensuring that the information displayed in your Digital Passport is accurate, current, complete and truthful. SKWADE does not independently verify user-submitted certifications or experience unless a specific verification service is explicitly indicated.
#8.4 Certifications
The Digital Passport may display diving certifications recorded by the user. Certifications are displayed based on user-provided information; SKWADE does not certify or validate those qualifications; certification agencies remain the authoritative source for certification status. Dive operators may request original certification cards or direct verification with the issuing organization.
#8.5 Diving Statistics
Statistics displayed within the Digital Passport are generated automatically from the user’s Dive Log and Ocean Observations, and may include total dives, total underwater time, maximum depth, number of dive sites, countries visited, Ocean Observations, and personal achievements. These statistics are informational and depend entirely on the accuracy of the underlying data.
#8.6 QR Code
The Digital Passport may include a QR Code to facilitate the sharing of selected information. Scanning the QR Code may provide access only to the information intentionally made available through the Passport. Users remain responsible for deciding when and with whom to share their Passport.
#8.7 Digital Wallet
Where supported, the Digital Passport may be added to compatible digital wallet applications. Wallet integration is intended solely to improve accessibility and convenience. Adding the Passport to a digital wallet does not change its legal status or constitute official recognition.
#8.8 Verification Services
Future versions of SKWADE may offer optional verification services for certain information, such as verified certifications, verified dive center affiliations, instructor verification, and professional status verification. Information not explicitly marked as verified should not be assumed to have been independently confirmed by SKWADE.
#8.9 Sharing Your Passport
Users may choose to share their Digital Passport with dive centers, instructors, dive buddies, liveaboards, training organizations, and other users. Sharing is entirely optional. Users remain responsible for determining what information they disclose.
#8.10 Availability
Some Passport features may depend on subscription level, platform compatibility, regional availability, supported devices, and future product updates. Not all features are available to every user.
#8.11 No Official Identification
The Digital Passport is not a government-issued identity document, an official certification card, proof of insurance, proof of medical fitness, proof of legal authority to dive, or a travel document. Users should always carry any official documentation required by law, certification agencies or dive operators.
#8.12 Suspension or Removal
If your SKWADE account is suspended, terminated or deleted, access to the Digital Passport may also be suspended or permanently removed. Any Wallet Pass associated with the Passport may cease to function or display outdated information after account termination.
#8.13 Future Development
The Digital Passport will continue to evolve. Future enhancements may include digital certification verification, instructor endorsements, specialty achievements, conservation participation, emergency information, professional credentials, and partner integrations.
#8.14 Core Principle
Your Digital Passport makes your diving experience easier to share — but it does not replace official documentation. Convenience should never be confused with official recognition.
#Chapter 9 — Certifications
In Summary. SKWADE allows users to record, organize and display their diving certifications for convenience and personal record-keeping. Unless explicitly indicated otherwise, certifications displayed within SKWADE are based on information provided by the user and are not independently verified by SKWADE. Certification agencies remain the authoritative source for the validity and status of diving certifications.
#9.1 Purpose
The Certifications module enables users to maintain a digital record of their diving qualifications. Depending on feature availability, users may add certifications, organize certification history, display certifications within the Digital Passport, associate certifications with Dive Logs, track specialty progression, and record professional qualifications.
#9.2 User-Provided Information
Unless expressly stated otherwise, certification information displayed in SKWADE is provided by the user, including certification agency, certification level, certification number, certification date, instructor name, dive center, and digital copies of certification cards. Users remain responsible for ensuring that this information is accurate and up to date.
#9.3 Certification Agencies
SKWADE supports certifications issued by recognized diving organizations. Examples may include SSI, PADI, CMAS, NAUI, SDI, TDI, RAID, BSAC, FFESSM, and other recognized agencies. The inclusion of an agency within SKWADE does not imply endorsement, affiliation or partnership unless expressly stated.
#9.4 Verification
Unless a certification is clearly identified as Verified, SKWADE does not independently confirm certification authenticity, validity, status, instructor authorization, or agency membership. Users should not assume that certifications displayed within SKWADE have been independently confirmed.
#9.5 Digital Copies
Users may attach digital copies of certification cards to their account. Digital copies are stored for the user’s convenience and do not confer any additional legal or professional status.
#9.6 Display
Certifications may be displayed within the Digital Passport, the Dive Log and other SKWADE surfaces. Users control which certifications are visible and to whom they are shared.
#9.7 Professional Certifications
Users who record professional qualifications remain solely responsible for complying with the standards and codes of conduct of their certifying agencies.
#9.8 Core Principle
Certification records within SKWADE are a convenience. Official recognition remains the responsibility of the issuing agency.
#Chapter 10 — Medical Documents
In Summary. SKWADE allows users to store selected medical documents relevant to diving for personal organization and accessibility. SKWADE does not assess medical fitness to dive.
#10.1 Purpose
The Medical Documents feature enables users to keep diving-related medical documents (such as medical certificates, prescriptions or fitness-to-dive statements) organized and available when needed.
#10.2 No Medical Assessment
SKWADE does not review, interpret, validate or assess medical documents. Only appropriately qualified healthcare professionals can determine fitness to dive.
#10.3 Sensitive Data
Medical documents may include sensitive personal information. SKWADE applies appropriate technical and organizational safeguards described in the Privacy Policy. Users choose whether to upload such documents.
#10.4 Sharing
Users decide when and with whom to share medical documents. Sharing is optional and remains under the user’s control.
#10.5 Retention and Deletion
Users may delete stored medical documents at any time. Deleted documents may remain temporarily in secure backups before permanent removal.
#10.6 Core Principle
Medical fitness to dive is determined by qualified professionals — not by SKWADE.
#Chapter 11 — Library
In Summary. The Library allows users to store and organize photographs, videos, documents and other personal files related to diving.
#11.1 Purpose
The Library is a personal storage and organization module. It is not a public content distribution platform.
#11.2 Ownership
Files stored in the Library remain the property of the user, subject to the User Content provisions of these Terms.
#11.3 Acceptable Content
Users must not upload content that violates Chapter 4 (Acceptable Use) or infringes third-party rights.
#11.4 Storage Limits
Storage capacity may depend on the user’s subscription plan and may evolve over time.
#11.5 Backups and Loss
SKWADE implements reasonable safeguards to protect stored files. Users are encouraged to maintain independent backups of important content.
#11.6 Deletion
Users may delete Library files at any time. Deletion may take effect immediately in the application and may remain temporarily in secure backups.
#11.7 Core Principle
The Library organizes what you upload — it does not turn private content into public content.
#Chapter 12 — Ocean Knowledge
In Summary. Ocean Knowledge is the SKWADE ecosystem of editorial and educational modules dedicated to the marine world. It currently includes the Marine Guide, the Coral Guide and Dive Sites, and may in the future include additional Ocean domains such as Marine Plants, Habitats and Ocean Articles.
Ocean Knowledge content is provided for educational and informational purposes only. It does not constitute scientific authority, navigation guidance or dive planning.
#12.1 Purpose
Ocean Knowledge helps divers discover, learn about and record encounters with the marine environment. Modules may include editorial descriptions, media galleries, taxonomy, geographic ranges, conservation notes, and related Dive Sites.
#12.2 Ocean Observations
Users may record Ocean Observations relating to Ocean Knowledge entities. Depending on feature availability, users may:
- record multiple observations of the same species;
- record coral observations;
- associate observations with a Dive Log;
- create observations independently of a Dive Log;
- attach notes to observations;
- attach dates to observations;
- attach locations to observations.
Ocean Observations remain User Content and are governed by Chapter 20.
#12.3 Observation Aggregates
SKWADE may automatically derive non-personal statistics and aggregates from Ocean Observations, including:
- observation counters;
- first observation;
- latest observation;
- species collections;
- achievement progress;
- Digital Passport summaries.
These derived statistics are generated to power the user’s own experience (collections, achievements, Passport). Their creation does not transfer ownership of the underlying User Content.
#12.4 Geolocation
Where the user grants the corresponding permission, the device’s optional location may be used to provide features such as:
- Seen Around You — recent observations recorded near the user;
- Nearby Dive Sites — Dive Sites geographically close to the user;
- Nearby Marine Life — species or corals commonly observed near the user.
Location permission is optional. Users may grant or revoke permission at any time through the operating system settings. Location-based features are provided for convenience and discovery and never replace dive planning, navigation, surface positioning or emergency procedures.
#12.5 Dive Site Links
Marine Species and Coral pages may link to Dive Site pages, and Dive Sites may reference associated species or corals. Dive Site information is provided for educational purposes only. Users remain responsible for independently evaluating local diving conditions, applicable regulations, access rights, and dive safety at any site.
#12.6 Display Names
SKWADE may display common names, scientific names and localized names for species, corals and other Ocean Knowledge entities, depending on language, provider and editorial choices. Displayed names are intended to improve usability and readability, and should not be interpreted as scientific authority or taxonomic ruling.
#12.7 Ocean Media
Editorial media (photographs, illustrations, videos) shown within Ocean Knowledge may originate from approved external providers.
Current approved providers include:
- Wikimedia Commons;
- GBIF (Global Biodiversity Information Facility).
Future providers may include scientific institutions, conservation organizations, professional photographers, dive centers, partner organizations, and — subject to the community-media provisions of these Terms — user contributions.
#12.8 Media Licensing
Externally sourced media remain subject to their original licences (for example, Creative Commons licences). SKWADE preserves and displays, where reasonably available:
- attribution;
- author credits;
- licence information;
- provider information;
- source information.
SKWADE does not claim ownership of third-party media and displays them under the terms of their original licences. Users who wish to reuse such media outside SKWADE must comply with the applicable licence.
#12.9 Editorial Review
Ocean Knowledge content may undergo editorial review by SKWADE. Editorial actions may include:
- approval;
- correction;
- replacement;
- hiding;
- removal;
- updates.
Editorial actions apply only to Ocean Knowledge content. They never modify a user’s personal Ocean Observations, Dive Logs or other User Content.
#12.10 Automated Content Enrichment
SKWADE may automatically enrich Ocean Knowledge content using approved providers and internal processing pipelines (collectively, the “Ocean Media Engine” and related editorial engines). Automatic enrichment may include:
- editorial descriptions;
- photographs and other media;
- media metadata;
- scientific references.
Automatic enrichment applies only to Ocean Knowledge content and never modifies User Content. It always preserves attribution, licence and provider information for third-party assets.
#12.11 Media Completeness
Ocean Knowledge content is progressively enriched over time. Some species, corals or sites may temporarily contain:
- limited information;
- partial galleries;
- no photographs.
This does not indicate an application error. Content coverage is expected to improve as providers, editorial review and future contributions expand.
#12.12 Dive Site Recommendations
Features that surface nearby sites, most observed sites, popular locations or recommended dive sites are informational recommendations only. They do not guarantee species presence, marine life sightings, underwater conditions, accessibility, legal permission to dive, or dive safety.
#12.13 Community Media (Future)
Future releases of Ocean Knowledge may allow additional media sources, including:
- user-submitted photographs;
- partner dive-center media;
- professional photographer contributions.
Any such contributions will be subject to moderation, editorial review, applicable licensing requirements, and any additional community guidelines published within SKWADE. Community media, when introduced, will remain subject to Chapters 4, 8 and 20 as applicable.
#12.14 Ocean Knowledge Expansion
Additional Ocean Knowledge modules (for example, Marine Plants, Habitats or Ocean Articles) may be introduced over time. Unless separate terms are expressly published for a specific module, future Ocean Knowledge modules automatically remain governed by these Terms.
#12.15 Educational Purpose
Ocean Knowledge is educational. Species and coral identifications, geographic ranges, behavioural notes and other editorial content should never be relied upon as the sole basis for scientific, regulatory or safety decisions.
#12.16 Core Principle
Ocean Knowledge helps divers explore, learn and observe with respect. Discovery must never come at the cost of the marine environment.
#Chapter 13 — Dive Computer Synchronization
In Summary. SKWADE may synchronize dive data with compatible dive computers and third-party diving platforms. Synchronization is a convenience feature and does not replace personal record-keeping or manufacturer software.
#13.1 Purpose
Synchronization enables users to import dive data from supported dive computers and platforms, and to keep their SKWADE Dive Log up to date.
#13.2 Supported Devices and Platforms
Supported devices and third-party platforms may evolve over time. Availability may depend on the manufacturer, the platform, the operating system and applicable API permissions.
#13.3 Credentials
Where synchronization requires authentication with a third-party platform, credentials are handled in accordance with the Privacy Policy and are used solely to perform synchronization.
#13.4 Data Integrity
Imported dive data is stored as received from the source. SKWADE does not modify original dive profiles except where the user explicitly edits editable fields.
#13.5 Failures and Delays
Synchronization may occasionally fail or be delayed due to network conditions, third-party service availability, device connectivity, or authentication issues. Users remain responsible for maintaining independent records of critical information.
#13.6 Third-Party Terms
Third-party platforms are governed by their own terms. SKWADE is not responsible for the availability, accuracy or continuity of third-party services.
#13.7 Core Principle
Synchronization simplifies record-keeping. It does not replace the user’s responsibility to verify imported information.
#Chapter 14 — Weather & Dive Conditions
In Summary. SKWADE may display weather forecasts, tides, currents and related environmental information to assist dive preparation. This information is provided for planning only.
#14.1 Sources
Weather and marine information is provided by third-party providers. SKWADE does not generate meteorological data and does not guarantee its accuracy.
#14.2 Planning Only
Weather information is provided solely to assist planning. Conditions on site may differ significantly from forecasts.
#14.3 User Responsibility
Users remain responsible for evaluating local conditions before diving, obtaining local briefings, and postponing dives whenever conditions appear unsafe.
#14.4 No Real-Time Safety
Weather features must not be used as a real-time safety, navigation or rescue system.
#14.5 Core Principle
Forecasts assist planning. On-site assessment governs every dive.
#Chapter 15 — Artificial Intelligence
In Summary. SKWADE integrates Artificial Intelligence to help users learn, plan and organize. AI outputs are informational and never replace certified training, professional advice or personal judgment.
#15.1 Purpose
AI features assist users through explanations, summaries, search, recommendations and educational content.
#15.2 Current and Future Capabilities
Depending on feature availability and roadmap, AI capabilities may include:
- marine species recognition;
- coral recognition;
- observation suggestions;
- dive summaries;
- educational explanations;
- content search and discovery;
- assisted content management for administrators.
Additional AI capabilities may be introduced over time. Unless otherwise stated, such capabilities remain subject to these Terms.
#15.3 Limitations
AI outputs may be incomplete, inaccurate or outdated. Users must verify AI-generated information before relying on it, particularly for safety, medical, legal or scientific purposes.
#15.4 Not Professional Advice
AI features do not provide medical, legal, scientific, safety or professional advice. They do not replace certified instructors, healthcare professionals, marine biologists, or certification agencies.
#15.5 Providers
AI features may rely on third-party AI providers. Data handling by such providers is described in the Privacy Policy.
#15.6 Prohibited Uses
AI features must not be used in violation of Chapter 4 (Acceptable Use), including for fraudulent, deceptive or unlawful purposes.
#15.7 Core Principle
AI assists. Humans decide.
#Chapter 16 — Free & Premium Services
In Summary. SKWADE is offered through Free and Premium tiers. Premium unlocks additional features and capacity. The composition of each tier may evolve over time.
#16.1 Free Services
Free Services provide core SKWADE functionality without payment, subject to feature availability, capacity limits and applicable restrictions.
#16.2 Premium Services
Premium Services provide additional features, extended capacity, or enhanced functionality in exchange for a subscription fee.
#16.3 Changes to Tiers
The composition of Free and Premium tiers may evolve as SKWADE develops. Where a change materially affects existing subscribers, SKWADE will provide reasonable notice.
#16.4 Trials and Promotions
SKWADE may offer trials, promotional offers or introductory pricing. Such offers are subject to their own conditions communicated at the time of the offer.
#16.5 Core Principle
Free access remains meaningful. Premium recognizes the users who choose to support and extend their SKWADE experience.
#Chapter 17 — Purchases & Payments
In Summary. Purchases of Premium subscriptions or other paid features are processed through supported payment providers and, on mobile platforms, through the app store billing systems.

Payments may be processed through Apple, Google, or other supported payment providers. Applicable payment terms of those providers apply in addition to these Terms.

Prices are displayed within the application prior to purchase and may include applicable taxes and fees, depending on jurisdiction.
#17.3 Billing Errors
Users should report suspected billing errors promptly through the appropriate channel (SKWADE support or the payment provider, as applicable).
#17.4 Refunds
Refund policies depend on the payment provider and applicable law. SKWADE cannot directly refund purchases processed by app store billing systems.
#17.5 Currency
Prices may be displayed in local currency, subject to conversion by the payment provider.
#17.6 Core Principle
Transparent pricing and reliable billing support a fair Premium experience.
#Chapter 18 — Subscription Renewal & Cancellation
In Summary. Premium subscriptions renew automatically unless cancelled before the end of the current billing period.

#18.2 Cancellation
Users may cancel a subscription at any time through the settings of the app store or platform where the subscription was purchased. Cancellation takes effect at the end of the current billing period.

#18.4 Post-Cancellation Access
After cancellation, Premium access continues until the end of the current billing period, after which the account reverts to Free tier subject to Chapter 19.

#Chapter 19 — Premium Downgrade & Data Management
In Summary. When a Premium subscription ends, the account continues under the Free tier. User Content is preserved, but certain Premium-only features may become read-only or unavailable.

User Content — including Dive Logs, Ocean Observations, certifications, Library files and Digital Passport information — is preserved when a subscription ends, subject to applicable law and any storage-limit adjustments described in the application.
#19.2 Feature Access
Features exclusive to Premium may become unavailable or read-only after downgrade. SKWADE strives to make downgrades non-destructive.
#19.3 Re-Upgrade
Users may re-subscribe at any time to restore full Premium functionality.
#19.4 Cloud Storage Downgrade Policy
Where cloud storage usage exceeds the Free tier limits after downgrade, SKWADE will apply a documented, non-destructive policy communicated within the application. Users will be given a reasonable opportunity to reduce usage before any further action.
#19.5 Core Principle
Downgrading a subscription should never mean losing your diving memories.
#Chapter 20 — User Content & Ownership
In Summary. You own your User Content. SKWADE receives only the limited rights necessary to operate the Services on your behalf.

Unless otherwise stated, User Content — including Dive Logs, Ocean Observations, photographs, videos, notes, documents, and other user-uploaded material — remains the property of the user.
#20.2 Licence to SKWADE
To operate the Services, users grant SKWADE a limited, non-exclusive, worldwide, royalty-free licence to host, store, transmit, display, back up and process User Content solely for the purpose of providing, maintaining, securing and improving the Services and features chosen by the user. This licence terminates when the corresponding User Content is deleted, subject to reasonable backup retention.
#20.3 Derived Statistics
Non-personal, aggregated statistics and metrics derived from User Content — including Ocean Observation aggregates described in Chapter 12 — may be used to power features such as collections, achievements and the Digital Passport. The creation of derived statistics does not transfer ownership of the underlying User Content.
#20.4 Responsibility
Users are responsible for the content they upload and for ensuring they have all necessary rights to upload it.
#20.5 Deletion
Users may delete their User Content at any time. Deletion may be reflected immediately in the application and may remain temporarily in secure backups before permanent removal.
#20.6 Sharing
User Content is private by default. Sharing occurs only when the user actively chooses to share, whether through the Digital Passport, exports, or future Community Features.
#20.7 Core Principle
Your memories remain yours.
#Chapter 21 — Intellectual Property
In Summary. All SKWADE software, branding, editorial content and other proprietary materials are protected by intellectual property laws.
#21.1 SKWADE Rights
SKWADE and its licensors retain all rights, title and interest in the Services, including software, algorithms, designs, editorial content, branding, trademarks, logos, and Ocean Knowledge editorial descriptions authored by SKWADE.
#21.2 Limited Licence to Users
Subject to these Terms, SKWADE grants users a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for their intended purposes.
#21.3 Third-Party Content
Third-party content displayed within SKWADE — including media obtained from Ocean Knowledge providers (Chapter 12) — remains the property of its respective owners and is used under the terms of the applicable licences.
#21.4 Trademarks
SKWADE trademarks and logos may not be used without prior written permission, except as expressly permitted by law.
#21.5 Feedback
Feedback voluntarily submitted by users may be used by SKWADE to improve the Services without further obligation.
#21.6 Core Principle
Respect for intellectual property protects both creators and users.
#Chapter 22 — Third-Party Services
In Summary. SKWADE integrates with a number of Third-Party Services. Those services are governed by their own terms and privacy policies.
#22.1 Categories
Third-Party Services may include authentication providers, payment providers, mapping services, weather services, AI providers, cloud infrastructure providers, media providers (including Ocean Knowledge providers), notification services, and dive computer platforms.
#22.2 No Endorsement
Integration with a Third-Party Service does not imply endorsement or partnership unless expressly stated.
#22.3 Availability
Third-Party Services may become unavailable, change functionality or modify their terms. SKWADE is not responsible for such changes.
#22.4 Data Handling
Where Third-Party Services process user data, such processing is described in the Privacy Policy.
#22.5 Core Principle
Third-Party Services extend SKWADE’s capabilities but remain governed by their own terms.
#Chapter 23 — Service Availability & Maintenance
In Summary. SKWADE strives to keep the Services available and reliable, but availability cannot be guaranteed at all times.
#23.1 Reasonable Effort
SKWADE uses reasonable technical and organizational measures to keep the Services available.
#23.2 Maintenance
Planned maintenance windows may temporarily affect availability. Where reasonably possible, SKWADE will provide advance notice.
#23.3 Interruptions
Unplanned interruptions may occur due to technical incidents, third-party outages, connectivity issues or force majeure events.
#23.4 No Continuous Availability Guarantee
The Services are not guaranteed to be continuously available, error-free or uninterrupted.
#23.5 Core Principle
Continuous improvement includes continuous investment in reliability.
#Chapter 24 — Disclaimer of Warranties
In Summary. SKWADE is provided “as is” and “as available”, to the fullest extent permitted by applicable law.
#24.1 No Implied Warranties
To the extent permitted by law, SKWADE disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service.
#24.2 Educational Nature
Features such as Dive Planning Tools, Ocean Knowledge, AI Features and Weather Information are educational aids. They do not constitute professional advice.
#24.3 Consumer Rights
Nothing in this chapter limits any consumer rights that cannot be excluded under applicable law.
#24.4 Core Principle
Honest disclaimers protect users and reinforce responsible use.
#Chapter 25 — Limitation of Liability
In Summary. To the maximum extent permitted by applicable law, SKWADE’s liability is limited as described in this chapter.
#25.1 Excluded Damages
To the extent permitted by law, SKWADE is not liable for indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, data or goodwill.
#25.2 Cap on Liability
To the extent permitted by law, SKWADE’s aggregate liability arising out of or in connection with these Terms and the Services shall not exceed the amounts paid by the user to SKWADE during the twelve (12) months preceding the event giving rise to the claim, or the applicable minimum amount required by law.
#25.3 Diving Activities
SKWADE is not responsible for injuries, incidents or losses resulting from diving activities, which remain the sole responsibility of the diver as described in Chapter 5.
#25.4 Consumer Rights
Nothing in this chapter limits any liability that cannot be excluded or limited under applicable law, including for gross negligence, wilful misconduct, or personal injury caused by SKWADE’s fault where such liability cannot be excluded by law.
#25.5 Core Principle
Fair limits on liability enable the responsible operation of a diving platform used worldwide.
#Chapter 26 — Indemnification
In Summary. Users agree to indemnify SKWADE against claims arising from their use of the Services in violation of these Terms or applicable law.
#26.1 Scope
To the extent permitted by law, users agree to defend, indemnify and hold harmless SKWADE, its affiliates, employees and partners against any third-party claim, loss or expense (including reasonable legal fees) arising from:
- the user’s violation of these Terms;
- the user’s violation of applicable law;
- the user’s infringement of third-party rights;
- content the user uploads or shares.
#26.2 Cooperation
SKWADE will notify the user of any claim covered by this section and may, at its option, participate in the defence.
#26.3 Consumer Protection
This chapter does not apply where prohibited by applicable consumer law.
#26.4 Core Principle
Shared responsibility protects the SKWADE community.
#Chapter 27 — Account Suspension & Enforcement
In Summary. SKWADE may suspend, restrict or terminate access where necessary to protect users, the platform or comply with the law.
#27.1 Grounds
SKWADE may suspend, restrict or terminate an account where reasonably necessary in response to a material breach of these Terms, fraud, security concerns, legal obligations or protection of users.
#27.2 Notice
Where reasonably possible and lawful, SKWADE will inform the user of the reason for the action and any available remediation steps.
#27.3 Effect
Suspension or termination may affect access to the Services, User Content, subscriptions and the Digital Passport. Applicable retention policies described in the Privacy Policy continue to apply.
#27.4 Appeal
Users may contact SKWADE support to request a review of enforcement actions.
#27.5 Core Principle
Enforcement is a last resort. Its purpose is protection, not punishment.
#Chapter 28 — Termination by User
In Summary. Users may terminate their SKWADE account at any time.
#28.1 How to Terminate
Users may delete their account through the settings of the application or by contacting SKWADE support.
#28.2 Effect
Account deletion terminates the user’s licence to use the Services and initiates deletion of User Content in accordance with the Privacy Policy and applicable law.
#28.3 Subscriptions
Users are responsible for cancelling active subscriptions through the applicable app store or payment provider.
#28.4 Backups
Deleted content may remain temporarily in secure backups before permanent removal.
#28.5 Core Principle
Leaving SKWADE should be as respectful as joining it.
#Chapter 29 — Changes to the Services & Terms
In Summary. SKWADE evolves. These Terms may evolve with it.
#29.1 Changes to the Services
SKWADE may introduce, modify or discontinue features as described in Chapter 1.
#29.2 Changes to the Terms
SKWADE may update these Terms to reflect legal, technical or product changes. Where changes are material, SKWADE will provide reasonable notice within the application, by email, or through other appropriate means.
#29.3 Continued Use
Continued use of the Services after the effective date of an update constitutes acceptance of the updated Terms, to the extent permitted by law.
#29.4 Historical Versions
Prior versions of these Terms may be made available for reference within the Legal Center.

#Chapter 30 — Governing Law & Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of that jurisdiction, without prejudice to any mandatory forum rules protecting consumers.
#30.3 Amicable Resolution
Before initiating legal proceedings, users are encouraged to contact SKWADE support to seek an amicable resolution.
#30.4 Online Dispute Resolution
Where applicable, users in the European Union may access the European Commission’s Online Dispute Resolution platform.
#30.5 Core Principle
Fair dispute resolution supports a trustworthy platform.
#Chapter 31 — General Provisions
In Summary. These provisions govern the interpretation and enforcement of these Terms.
#31.1 Entire Agreement
Together with the documents incorporated by reference, these Terms constitute the entire agreement between the user and SKWADE.
#31.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
#31.3 No Waiver
Failure to enforce a provision does not constitute a waiver of that provision.
#31.4 Assignment
Users may not assign their rights under these Terms without SKWADE’s prior written consent. SKWADE may assign its rights and obligations in connection with a reorganization, merger or transfer of business, subject to applicable law.
#31.5 Force Majeure
Neither party is responsible for failure to perform obligations due to events beyond its reasonable control.
#31.6 Notices
SKWADE may communicate with users through the application, by email or through other appropriate means.
#31.7 Headings
Section headings are provided for convenience only and do not affect interpretation.
#31.8 Language
In case of discrepancy between translated versions, the version designated by SKWADE as controlling shall prevail, to the extent permitted by law.
